General Terms and Conditions

1. Introduction

All the bookings made through our website or through mobile services presuppose full and unconditional acceptance and the validity of each and every term of the General Terms and Conditions.

The agreement concerning the following General Terms and Conditions, occurs at the time of the booking. No booking may happen without this agreement.

The General Terms and Conditions applicable at the time of contracting the reservation apply.

If one of the provisions of the General Terms and Conditions prove to be inadequate or null, all of the other provisions of the General Terms and Conditions shall not be affected and remain valid. For the remainder legal provisions apply.

2. Subject-matter

  1. These General Terms and Conditions establish the rights and obligations of the parties under any kind of booking.
  2. These General Terms and Conditions govern all of the necessary steps to the booking and the monitoring of the booking by the parties.
  3. The client acknowledges and accept these General Terms and Conditions.

3. Pricing policy

  1. The prices are indicated during and after the online booking process.
  2. The indicated price is per room for the number of person(s) and for the dates indicated.
  3. The price is confirmed to the guest all taxes included, in Swiss francs (CHF). It is valid only for the dates indicated.
  4. All bookings, whatever they are from, are payable only in Swiss francs (CHF). Payments in other currencies are not accepted.
  5. Unless otherwise specified additional services (breakfast, extra cleaning) are not included in the price.
  6. Unless otherwise specified the city tax is not included in the price. This amount shall be paid directly at the front desk of the hotel.
  7. The price takes into account the applicable value-added tax (VAT) at the date of booking making. The value-added tax (VAT) will be charged at the date of the invoice.
  8. Any modification or introduction of new legal taxes or legally imposed by the authority will be charged at the date of invoice.

4. Payment

  1. For the bookings with a Standard rate the guest communicates the details of a credit card (Visa, Mastercard, American Express, Diners).
    In order to protect and encrypt the credit card details when they transit through our website, the security technology SSL (Secure Socket Layer) is used.
  2. For the non-refundable bookings, the amount of lodging fare is automatically debited at the moment of booking. The city tax and additional services (for example breakfast) are to be paid at the front desk of the hotel.
  3. Payment is debited at the hotel during the stay, except for special conditions and fares. The debit is therefore made upon booking. This prepayment is a deposit.
  4. If a guest does not show up or cancel his booking less than 24h before the arrival date, the first night will be charged (c.f. cancellation policy). By accepting the terms and conditions mentioned in the confirmation, you allow us to debit the amount from the credit card indicated.
    We advise our guests to take out a cancellation insurance in case of unexpected events (accident, sickness, delayed arrival or early departure).

5. Privacy Policy

All information received are strictly confidential and it won’t be transferred to any third party in accordance with the law on data protection (RS 235.1).

Video surveillance camera
For security reasons, Hôtel De La Source records activity within its establishment in various places (Halls, Front Desk and entrance). Recordings are valid for 72 hours before being deleted. The tapes recorded are used only in case of dispute (theft, assault, etc.). Only the Police, following a denunciation and the Management are allowed to play back recordings. By accepting the General Terms and Conditions you agree to be filmed.

Wifi
Hôtel De La Source offers free wifi access to all customers. However, our hotel cannot guarantee the security of this service, nor the fact that the provider does not retain the user metadata. By accepting the General Terms and Conditions the guest accept, with full knowledge of the facts, the use of the wifi network.

6. Responsibility

Hôtel De La Source declines all responsibility in case of death, personal injury or property damage for any person renting an accommodation unless there is a proven fault on the part of the hotel.

Hôtel De La Source declines all responsibility in case of loss, damage, delay due to a cause which is beyond its control in particular in case of force majeure, explosions, floods, storms, fire, accidents, acts of war, civil or terrorist threats, restrictive measures from any official authority, strike or protest. In such cases, the booking may be cancelled automatically without compensation requested by the guest. (cf. 4)

Hôtel De La Source declines all responsibility for noise and nuisance of any kind whose cause is beyond its control.

6.1 Objects brought to the accommodation by guest

Hôtel De La Source accepts no responsibility for objects brought and stored by the guest in the hotel permises, they are at the risk of the guest. The hotel does not insure surveillance. The hotel declines any responsibility for the loss, disappearance or deterioration of the objects brought, except in case of serious negligence or its intent. It is the guest’s responsibility to insure the safe keeping of the objects brought to the hotel.

The material brought to the hotel must respect the fire security requirements. The hotel has right to request an official certificate asserting the compliance with the requirements. Because of the possible deterioration, the list and the display of the objects must be previously discussed with the hotel.
Exhibition materials must be removed from the permises at the end of event. The hotel has right to remove and/or store the material or objects left. In that case the guest will have to pay for the removal or storage.Packaging (boxes, plastic wraps etc.) in which the material is delivered to a guest or to a third party for the event must be removed by the guests. If packaging is left on the hotel permises, the hotel has right to remove the material or objects left. In that case the guest will have to pay for the removal.

6. 2 Acts, use and responsibility

a) Hotel
The hotel accepts no responsibility within the scope of law for moderate or minor negligence. The hotel will be liable only for intentional or caused by gross negligence damages. If defects or disturbances occur in hotel services, it will try to solve the problem as soon as the guest will have informed the front desk about it. If the guest fails to inform the front desk in time, he has no right to any price reduction on his room. The hotel declines any responsibility for theft and deterioration of objects or materials brought to the hotel by third party. Are considered brought the objects that the guest keeps in his room and the safe provided for this purpose. The hotel accepts no responsibility for moderate or minor negligence. The hotel does not accept objects and valuables in the front desk safe. Please, refer to articles 487 following from the Swiss code of obligations.

b) Guest
The guest is liable to the hotel for every deterioration and loss caused by him, his invitees or people participating to an event that he organizes.
Moreover, he is responsible for equipment or means that he obtains with a third party and is liable for damages, loss and rehabilitation.

C) Third party
The third party who make a booking for a guest is the guest’s substitute.

7. Overbooking

When there is no available accommodation in the hotel or in case of force majeure the hotel can book an accommodation for a part or the whole stay in a hotel nearby of the same category or of a superior category for the same amenities and services. All the fees generated by transfer will be paid by the Hôtel De La Source.

8. Accommodations

Standard Category

  • Single room (180cm bed)
  • Double room (180 cm bed)
  • Twin room (2x90 cm bed)

Superior Category

  • Single room (180cm bed)
  • Double room (180 cm bed)
  • Twin room (2x90 cm bed)

Category Family Studio and Loft Studio

  • Double room (180 cm bed) and a sofa (160 cm bed)

The VAT and service are included in prices.

The price mentioned in your confirmation of booking can’t be changed even in case of modifications in the Hôtel De La Source pricing policy.

9. Breakfast

The Continental breakfast is not included in the price of the accommodation. This service costs CHF 15.00 per person and per day. Breakfasts ordered but not consumed won’t be reimbursed.

10. City tax

The payment of city tax which costs CHF 2.60 per person and per night is mandatory according to the regulations of Yverdon’s metropolitan area. The price of the city tax can be changed in any time without notice.

11. Individual bookings

Every client can book a room through different channels :

As soon as the booking process is over, the front desk of the Hotel De La Source will send a confirmation of booking by email. This confirmation includes all necessary details in order to ensure a good stay.

12. Group bookings

A special price is offered for a booking of more than 9 rooms. The price for a group booking is available on request at the front desk. VAT and service are included in this price.

For this type of booking the Hotel De La Source front desk will send a contract to complete, sign and return back to the hotel.

Before signing this contract, no room is blocked and the booking is not confirmed.

12.1 Booking with a guarantee:

  1. A maximum of 40 accommodations can be booked for a group if the booking is guarantee by credit card
  2. The company pays for all the participants or accepts to guarantee the total amount of booking
  3. If all the accommodations are not booked 6 weeks before the check-in date, the following cancellation policy applies
  4. Cancellation policy :
    - The cancellation must be transmitted at the reception desk in a written form (fax, postal or email)
    - If the cancellation occurs less than 45 days before the begging of the stay, 25% of the total amount of the booking will be charged
    - If the cancellation occurs less than 30 days before the begging of the stay, 50% of the total amount of the booking will be charged
    - If the cancellation occurs less than 15 days before the begging of the stay, 70% of the total amount of the booking will be charged
    - If the cancellation occurs less than 48 hours before the begging of the stay, the total amount of the booking will be charged
  5. In case of impossibility to guarantee by credit card, a deposit of 30% of the total booking amount will be requested 6 weeks before the check-in date as well as the transfer of the final amount 48 hours before the beginning of stay.
  6. Dommage reduction :
    - For individual or group cancellations, the hotel tries to sell the accommodations not used to other clients. To the extent that the hotel can provide the services cancelled in a reasonable time to a third party it reduces the damage to the first guest

12.2 Booking without guarantee :

  1. 30 rooms can be booked without fees up to 6 weeks before the beginning of the stay
  2. The organizer or the head of the group have to send the code at Hotel de La Source in order to enable the participants to book on the website of the hotel: https://www.hoteldelasource.ch/en or by sending the request at the email address: info@hoteldelasource.ch
  3. The guests book and pay directly their stay at the reduced prices
  4. The organizer or the head of the group does not guarantee the booking
  5. On the handover date, i.e. 6 weeks before the beggining of the stay, the Hotel De La Source releases the unreserved rooms free of charges
  6. Unless otherwise stated, the distinctive code and preferential rates remain valid but subject to availability to the Hotel De La Source

13. Booking by an external representant

  1. The guest can mandate an external representant to manage his group booking.
  2. The prices will be increased by the commission requested by the representant.

14. Moyens de paiement

The following means of payment are accepted:

  • Cash
  • Credit cards :
    - Visa
    - MasterCard
    - American Express
    - Dinners
    - CUP
  • Debit cards :
    - Postcard
    - Maestro
  • Invoice (payable within 10 days). An invoice can be sent in case of billing instruction for individual clients or groups whose rooms are paid by a company. This option is only possible for the companies present in the Swiss commercial register.

15. Refund

In case of error when booking or when paying by the guest, no refund or postal transfer will be made by Hotel De La Source.

Non-refunduble bookings won’t be refunded in any case.

Similary in the event of the early departure, the total amount of the stay is requested and no refund will be made.

16. Evolution and changes in the General Terms and Conditions

These General Terms and Conditions can be modified or changed at all time by the Hotel De La Source. In this case the new version will be published online by the Hotel De La Source. It will apply as soon as it will be published except for the booking made previously.

17. Applicable law/Jurisdiction

The legal relationship between the guest and the Hotel De La Source shall be governed by the low of Switzerland.
The court of jurisdiction is in Yverdon-les-Bains.

18. Conclusion

This regulation is subject to change at all time and applies to all our services available directly or indirectly (with our partners), online, by email or phone. By accessing our website or any other platform to search for information or to use, or to book you acknowledge that you read and accept these General Terms and Conditions.

Internal Regulations

1. Access conditions

  • The rooms of the hotel must be used according to their original purpose.
  • The number of people occupying the accommodation can’t exceed the number provided in the confirmation letter.
  • Accommodations are provided for a set number of people. To comply with the hotel safety rules, no additional people may stay in the accommodation.

2. Presentation

The Hotel De La Source is free to deny entry to any guests whose attire scruffy or indecent, or to guests whose behaviour is noisy, disrespectful or an affront to common decency.

3. Payment

Failure to pay will result in the immediate expulsion of the guest subject to legal proceedings for the settlement of his due. The guests are required to present a valid identity card on arrival. The card used for any online payments must be presented to Reception.

4. Pets

Small pets (dogs and cats) are allowed, subject to the conditions: they must be kept on a leash in all common areas of the hotel, they must be taken outside the hotel to relieve themselves. An additional charge per animal will be charged according to the rate conditions. If the accommodation is damaged, a fixed fee of CHF 200 will be charged.

5. Non-smoking

The Hotel De La Source is fully non-smoking, including the rooms. We reserve the right to charge an amount of CHF 250 to any guest who has smoked in their room, and deny them an access to the hotel in future. If the smoke alarm is triggered, the fine will be CHF 500. We can’t condone smoking: quite apart from the discomfort caused to the next guest, it requires a full clean of all fabrics in the room, and the room will be unavailable for 2 days (leading to operating losses).

6. Responsibilities

The Hotel De La Source accept no responsibility in case of theft of belongings brought by the guest in the rooms within the scope of the Swiss law.

Any equipment or belongings of the Hotel De La Source taken away and not returned will be charged immediately at the initial price.

7. Check-in/check-out

Check-in begins at 2 p.m. and check-out deadline is 11 a.m. The Hotel De La Source reserve the right to charge 50% of the night price in case of late check-out.

Late departures and morning arrivals are possible subject to availability, and will be charged according to the rate conditions.

8. Prohibition of domiciliation

It is forbidden to establish domicile at the Hotel De La Source.

9. Nuisance

The guest has to avoid to make excessive noise which could disturb the other guests and neighbours. The guest has to respect the silence period during the night from 9 p.m. until 8 a.m. Any noise in the vicinity of the hotel connected with the behaviour of a guest or of a pet for which they are responsible may result in the hotel asking the guest to leave the establishment. Commercial transactions of any kind are strictly prohibited.

10. Use of public areas

It is not allowed to guest to store objects or clutter up public areas of the Hotel De La Source, temporarily or for a longer time with any object (bikes, luggage, bins…).

11. Room equipment

It is not allowed to change the layout, arrangement and equipment of the room. It is also forbidden for guest to move any furniture and accessories belonging to the Hotel De La Source or bring any furniture into the room.

The supply of bath linen, hospitality products and the daily cleaning of the room are included in the price.

12. Repair and maintenance services

The cleaning is provided every day and after the departure. If the guest needs other services, he will have to contact the Reception of the Hotel De La Source.

Moreover, the guest is not allowed to repair furniture or equipment by himself. In the event of stains on furniture or carpet, he will have to contact the Reception.

13. Damage

The rooms made available to our guests are checked daily to ensure they are in good condition and all equipment is working. Accordingly, by occupying a room, guests accept the contents of the room and the state of the furniture. We invite our guests to immediately notify Reception if anything is missing.

In the event of damage, guests must accept their civil liability. The Hotel De La Source reserves the right to charge guests the cost of the damage, as well as a penalty as compensation for the operating loss (the room can’t be occupied during repairs), amounting to between CHF 1000 and CHF 2000. The Hotel De La Source may charge a fee for cleaning if the room is left in a condition that is considered inappropriate.

14. Police regulation

Every guest is responsible for all breach of the legal provisions of the Swiss law. The use of Internet is subject to the Swiss law.

15. Conclusion

These Internal Regulations are subject to change at any time and apply to all our services available directly or indirectly (with our partners) online, by email or by phone. By accessing our website or any other platform to search for information or book, you acknowledge that you read and accepted these Internal Regulations.

Guests who do not abide by these Internal Regulations will be asked to leave the Hotel De La Source and will not be entitled to a refund. The hotel reserves the right to debit the amount of undeclared consumptions at check-out, as well as the cost of damage caused in the room. This amount will be debited to the credit card of which an imprint was supplied at check-in. The Hotel De La Source is not obliged to inform the guest, but will happy to provide an invoice on request.
